In the event of resale
Sales of 5,000 euros or less are completely exempt from taxation.
For the resale of a work priced above 5,000 euros, a flat-rate tax of 6.5% of the sale price applies, or a capital gains tax (36.2%)
with a 5% annual deduction
starting in the third year, resulting in full exemption after 22 years.

TAXATION FOR PROFESSIONALS & BUSINESSES
For businesses, the purchase of a work created by a living artist qualifies for a specific tax provision, governed by Article 238bis AM of the General Tax Code.
A regulated deduction mechanism
Businesses and professionals may deduct the purchase price of an original work of art from their taxable income.
This deduction is applied on a straight-line basis over a period of 5 years, including the year of acquisition, up to a limit of 0.5% of annual revenue.
This mechanism allows the acquisition of a work of art to be considered as part of a comprehensive strategy that takes into account both asset management and tax considerations.
Eligibility Requirements
The artwork must be original and created by a living artist.
The asset must be recorded as an asset of the company.
The artwork must be displayed in a location accessible to employees or the public for 5 years.
